Overpeck's life read like a volume of Horatio Alger: decorated hero in one war, military lawyer in another. respected attorney in private practice, tapped by the governor to guide a fledgling veterans' agency. But 11 years ago, the native Kansan dropped out of sight, after pleading guilty to embezzling about $900 from an estate he was charged with protecting. Overpeck spent the next decade in retirement, traveling around the country. A heart attack ended his journey Sunday at age 65 near his sister's home in Fort Collins, Colo.

Raymond A. Overpeck was born Jan. 14, 1917 in Emporia. His father, Ray H. Overpeck, was a legislative representative for the Order of Railway Conductors in Kansas.

OVERPECK received a bachelor of arts degree from the College of Emporia. When World War II erupted, Overpeck joined the Marines, which became a second home to him. "'He really loved the Marine said his sister. Emilie M. Bell.

As part of the Third Marine Division, Overpeck took active part in major landings at Iwo Jima, Guam and Bougainville. His exploits won him a silver star, bronze star and Purple Heart. Aftert the war, Overpeck was named by Gov. Frank Carlson to head the state office of veteran affairs. For two or three years, Overpeck traveled though the state, informing veterans of benefits and helping them file claims, Bell said.

BY 1949, HE had graduated from Washburn University with a law degree. He had been a member of the Phi Alpha Delta legal fraternity. But his career was cut short when he was recalled to active service in the Korean War. After graduating from the U.S. Naval School of Justice in Rhode Island, Overpeck served as a trial and defense counsel and law officer of general courts martial.

He was transferred to the Third Marine Air Wing as a staff legal officer. When he left the service in 1955, Overpeck had reached the rank of lieutenant colonel He soon joined the Wichita law firm of Ratner. Mattox and Ratner, later renamed Payne Ratner and Sons. He also worked at the Kansas Claims Service and then moved to Augusta in 1965 to join the firm of City Judge Robert A. Atherton.

BUT IN JUNE 1971, Overpeck was charged with two counts of embezzlement of more than $50. He was accused of embezzling about $890 from the estate of Marvin W. Collins while acting as conservator in 1969. Overpeck voluntarily surrendered his law license and pleaded guilty. He was placed on probation while he paid back the estate.

Bell would not discuss the details of Overpeck's resulting retirement except to say that he traveled, using Fort Collins as a home base. Services with full military honors will be held at 1 p.m. Wednesday at the Grandview Cemtery in Fort Collins. Survivors include two daughters, Michelle Anderson, Prairie Village, and Sallie Hunt.
